Other payments due to the Property Developer, other than the Purchase Price of the Unit and the Price of the rights appurtenant thereto (i.e. storage units, parking spaces in the underground garage, individual bicycle rooms):

1.  maintenance fees understood as costs related to the upkeep and current use of the property in respect of the common areas and management of the building and its common areas (including: maintenance, cleaning, repair fund, greenery upkeep) and utilities related to the Unit, such as water, electricity, gas, heating, collected by the Property Developer in the period from the date of signing the Unit handover report (or in the event of failure to appear for acceptance on the date specified in the Development Agreement — upon the lapse of such acceptance deadline set by the Property Developer) until the date on which a property manager is appointed by the owners of the Units;
2. statutory interest for late payment of any portion of the purchase price, provided that it shall not exceed 2% of the Gross Price;
3. contractual penalty equal to statutory interest for late payment shall be payable in the event of a delay in concluding the agreement transferring ownership of the Subject Matter of the Agreement, provided that it shall not exceed 2% of the Gross Price;
4. any costs of modifications to the Units requested by the Buyer from the Property Developer, the price of which shall be agreed in a separate agreement on Additional and Interior Works.

The payments payable to the Property Developer in the event of a failure to conclude the ownership transfer agreement:

5. the obligation to pay a contractual penalty of PLN 150 for each day of delay (provided that it shall not exceed 2% of the Price of the Subject Matter of the Agreement) in the event of the Buyer's failure to provide consent to the deletion of the claim for the transfer of ownership of the property, if the Buyer submits a declaration of withdrawal from the Agreement;
6. the obligation to pay a lump-sum monetary penalty equivalent to 2% of the Purchase Price in the event of the Property Developer’s withdrawal from the Agreement due to the Buyer’s fault, resulting from a failure to pay the Price despite sending a payment notice with an additional 30-day payment deadline;
7. the obligation to pay a lump-sum monetary penalty equivalent to 2% of the Purchase Price in the event of the Property Developer’s withdrawal from the Agreement due to the Buyer’s fault, resulting from the Buyer’s failure to appear for the handover of the Subject Matter of the Agreement;
8. the obligation to pay a lump-sum monetary penalty equivalent to 2% of the Purchase Price in the event of failure to execute the agreement transferring ownership of the Subject Matter of the Agreement, despite two written notices delivered at least sixty (60) days after the date of delivery of the first notice, unless the Buyer’s failure to appear is caused by force majeure;
9. reimbursement of costs incurred to restore the Unit to its original condition — in the event that the Agreement does not take effect for any reason after the Buyer has made any modifications to the Subject Matter of the Agreement and fails to restore the Unit to the developer-standard condition on their own;
