INFORMATION CLAUSE

In accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – Official Journal of the EU L 119 of 04.05.2016), referred to as GDPR, I inform you that:

  1. The controller of your personal data is TOSCOM DEVELOPMENT SP. Z O.O., ul. Krucza 2A, 53-411 Wrocław (hereinafter: CompanyorController)
  2. Pursuant to Article 37(1)(a) of the GDPR, the Controller has appointed a Data Protection Officer (DPO) – Mariusz Kania – who oversees the sphere of personal data processing on his behalf. The DPO can be contacted at the email address iod@toscom.pl or by letter, writing to: TOSCOM DEVELOPMENT SP. Z O.O., ul. Krucza 2A, 53-411 Wrocław with the note “Data Protection Officer”.
  3. Your personal data will be processed for the purpose of executing contracts and applications and orders submitted by you, based on the Regulation of the European Parliament and of the Council (EU) 2016/679 dated April 27, 2016:
    1. Article 6(1)(b), processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
    2. Article 6(1)(f), processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party.In other cases, if you have consented to the processing of personal data to:
      1. conduct direct marketing of products and services of TOSCOM DEVELOPMENT SP. Z O.O. and entities within the Capital Group off TOSCOM DEVELOPMENT SP. Z O.O. (list of entities);
      2. send commercial information regarding products and services of entities within the Capital Group of TOSCOM DEVELOPMENT SP. Z O.O. (list of entities), by means of electronic communication to the e-mail address provided, in accordance with Article 10(2) of the Act of July 18, 2002 on providing services by electronic means;
      3. conduct direct marketing of entities within the Capital Group of TOSCOM DEVELOPMENT SP. Z O.O. (list of entities), using telecommunication terminal equipment, through communication by telephone and SMS/MMS messages to the provided telephone number, in accordance with Article 172(1) of the Telecommunications Act of 16.07.2004;
    3. personal data will be processed on the basis of the consent given, to the extent and for the purpose specified in the content of the consent (Article 6(1)(a) of the GDPR).
  1. You have the right to access the content of your data and the right to rectification, deletion (when separate consent has been given), restriction of processing, the right to data portability and the right to object.
  2. Your data will be processed until there is a basis and purpose for processing:
    1. in the case of the necessity of the data for the performance of the contract – for the duration of its performance, and for the period necessary for the assertion of claims, as well as due to obligations provided by law.
    2. in case the basis for data processing is the legitimate interest of the controller – until the existence of this legitimate interest.
    3. in the case of granting consent for the processing of personal data – until the withdrawal of the granted consent.
  1. We do not share personal data obtained from you with third parties, with the exception of entities cooperating with TOSCOM DEVELOPMENT Sp. z o.o. exclusively for purposes related to the execution of contracts. In such cases, the amount of data provided to entities cooperating with TOSCOM DEVELOPMENT Sp. z o.o.  is limited to the required minimum.
  2. You have the right to demand from the Controller access to your data, rectification, erasure or restriction of processing, and the right to object to processing, and, with respect to data provided on the basis of your voluntary consent, also the right to withdraw your consent at any time without affecting the legality of processing carried out on the basis of consent before its withdrawal.
  3. In addition, you have the right to lodge a complaint with the President of the Office for Personal Data Protection (PUODO) in Warsaw if you consider that the processing of personal data concerning you violates the provisions of the General Data Protection Regulation of April 27, 2016;
